1. Introduction
These General Terms and Conditions expressly regulate the relationship between DSV CBD LAB S.L. (hereinafter, “Moodly”) with CIF B72780489 and address at Calle Miami 27 5A, 28027, Madrid, Spain, and third parties (hereinafter, “Users”) who register an account or purchase products through the online store of the website [URL del sitio web].
2. User Obligations
2.1. The User agrees, in general, to use the store, purchase the products and use each of the services of the store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the store by Users or that could damage or cause damage to the property and rights of Moodly, its suppliers, Users or in general any third party.
3. Purchasing Process
3.1. The products offered in the store, together with their characteristics and prices, will appear on the screen. In addition to price, before confirming the order, the user will be shown the total shipping costs to the buyer’s address. The prices shown on the screen are in Euros and include VAT and any other applicable taxes and are valid at all times, except in the case of typographical errors.
4. Availability
4.1. The availability of products offered by Moodly through its website may vary depending on customer demand. Although Moodly updates the stock periodically, the product requested by the customer may be out of stock at that time. In case of non-execution due to unavailability, Moodly will notify the client by e-mail as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. Moodly may give the customer the double option of: supplying the customer with a product of similar or higher quality without any increase in price, or, unless Moodly has justified and demonstrable reasons for doing so, refunding the sums paid for the cancelled order within the same period.
5. Payment Methods
5.1. When placing an order, the customer is free to choose to pay for Moodly purchases by credit or debit card, bank transfer, PayPal or other electronic payment methods. In certain cases and in order to prevent fraud, Moodly reserves the right to request a specific form of payment from a customer if the identity of the purchaser is not reliably proven.
6. Return and Cancellation Policy
6.1. Right of Withdrawal: The customer shall have the right to withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period shall expire 14 calendar days from the day on which the customer or a third party indicated by the customer, other than the carrier, acquired material possession of the goods.
6.2. Returns of defective products: The customer has the right to return those products that are considered defective according to the applicable legislation. Moodly will refund the price and shipping costs, as well as any costs incurred by the customer in returning the defective product.
7. Applicable Law and Competent Jurisdiction
These conditions shall be governed by or construed in accordance with Spanish law in all matters not expressly set forth herein. Moodly and the user agree to submit any dispute that may arise from the provision of the products or services covered by these Terms to the Courts and Tribunals of the user’s domicile.
